Terms & Conditions
By booking a photography session, or by purchasing or using a gift voucher, you agree to the following terms and conditions.
PRIVACY
Your privacy matters. Personal information is used only for communication, session planning, and order fulfillment.
BOOKING & SESSION DETAILS
AVAILABILITY
Sessions are scheduled on a pre-agreed date and time, subject to studio availability. Certain session types may be limited to specific days or times. Session fees cover the photographer’s time only and do not include products or digital images unless otherwise stated.
WHAT’S INCLUDED
Unless otherwise stated, all sessions include only the photography experience. Artwork, prints, and digital images are purchased separately at your design and ordering appointment.
SESSION FEES
Session fees are required to secure your booking and are non-refundable.
DEPOSITS and gift credits
Deposits and gift credits may be applied toward your order only if:
You attend your session
You attend your ordering appointment
You have not canceled or violated scheduling terms
Deposits are forfeited if appointments are missed, canceled outside policy, or rescheduled improperly.
AGE REQUIREMENTS
All bookings must be made by someone 18 or older. A parent or legal guardian must be present for all minors.
SCHEDULING & ATTENDANCE
RESCHEDULING
A minimum of 5 days’ notice is required to reschedule. Sessions may be rescheduled once.
Late arrivals of more than 10 minutes may result in a shortened session or cancellation and may be treated as a no-show.
NO-SHOWS
Failure to attend within 10 minutes of your scheduled time is considered a no-show. All fees, deposits, and promotional credits are forfeited. Rebooking requires a new session fee and is subject to availability.
ILLNESS
If anyone in your group is sick or contagious, please contact me to reschedule. Standard rescheduling policies apply.
DURING YOUR SESSION
BEHAVIOR
You are responsible for the behavior of everyone attending your session, including pets. Sessions may be stopped if behavior is unsafe, disruptive, or disrespectful. You are responsible for any damage to studio property.
PETS
Pets must be fully vetted and vaccinated, safe, well-managed, and comfortable in new environments. Sessions may be stopped if a pet is distressed or poses a safety concern.
LIABILITY
You participate in sessions at your own risk. I am not responsible for injury, loss, or damage except where required by law.
LOCATION
Sessions take place at my studio in Marionville, Missouri, unless otherwise arranged.
CREATIVE CONTROL
I will guide posing and styling throughout your session. Specific requests are welcome when possible, but final artistic decisions remain at my discretion.
ORDERING, PAYMENT & FINALIZATION
PRICING
Pricing in effect at the time of your ordering appointment applies. Prices are subject to change without notice.
VIEWING POLICY
Images are presented at your design and ordering appointment. This is the time to select and purchase your artwork.
ORDERING & FINALIZATION
By placing an order, you confirm that all selected products and details have been reviewed and approved.
Images not ordered are not kept on file after the design and ordering appointment.
PAYMENT
Payment in full is required at your design and ordering appointment. Orders are not placed into production until full payment has been received.
SALES POLICY
Due to the custom nature of commissioned artwork, all sales are final. Orders cannot be canceled, reduced, or refunded once placed.
PROCESSING FEES
In the event that an order adjustment, cancellation, or refund is approved at the sole discretion of Barbara Neely Designs, any processing fees associated with the original transaction (including credit card fees or third-party financing such as Affirm and Klarna) will be deducted from the refunded amount.
COMPLIMENTARY CREDIT
Any promotional credit must be used at your ordering appointment and cannot be applied later, transferred, or redeemed for cash.
PAYMENT OPTIONS
Payment is accepted via cash or card.
Financing options may be available through Affirm and Klarna for those who qualify.
AFTER YOUR ORDER
COLLECTION & STORAGE
Orders are typically ready within 3–6 weeks.
Orders must be collected within 60 days of notification. Unclaimed orders may incur storage fees or be considered abandoned.
COLOR & PRODUCT VARIATION
Slight variations in color, tone, or finish are normal and not considered defects.
PRODUCT DEFECTS
If a product is defective, it must be reported within 7 days of pickup. I will repair or replace verified defects. Damage after collection is not covered.
VOUCHERS & PROMOTIONS
VOUCHERS
Gift vouchers and promotional sessions:
Must be used within the stated expiration period
Are non-refundable and not redeemable for cash
Are limited to one per household unless otherwise stated
Missed appointments or cancellations void voucher benefits.
LEGAL & POLICIES
COPYRIGHT
All images are the property of Barbara Neely Designs and are protected by federal copyright law. Barbara Neely Designs retains exclusive ownership of all digital files and the right to use images for display, portfolio, marketing, advertising, and publication.
Client agrees that no images may be copied, reproduced, or altered in any way without prior written permission.
SOCIAL MEDIA FILES
Digital files are provided for personal use only, including social media sharing and personal websites.
Images may not be altered, edited, cropped, or have watermarks removed. Printing is not permitted from these files. Commercial use is not allowed without written permission.
PHOTOGRAPHY POLICY
No personal photography or video recording is permitted during sessions or ordering appointments.
REFUNDS
All payments are non-refundable except where required by law.
CANCELLATION POLICY
You may cancel your session at any time; however, all fees and deposits are non-refundable. I reserve the right to cancel a session and refund any fees paid.
FORCE MAJEURE
If circumstances beyond my control (illness, weather, emergencies) arise, your session will be rescheduled.
REFUSAL OF SERVICE
I reserve the right to refuse service if policies are violated, behavior is inappropriate, or safety is at risk.
GOVERNING LAW
These terms are governed by the laws of the State of Missouri.
